Become A Patent Agent

There are several categories of applicants. No matter which category you rely on, you must furnish copies of your official and original transcripts to the USPTO

Category A:

By earning a bachelors degree in one of the fields listed below;

If you have a computer science degree accredited by the Computer Science Accreditation Commission (CSAC) of the Computing Sciences Accreditation Board (CSAB), or by the Computing Accreditation Commission (CAC) of the Accreditation Board for Engineering and Technology (ABET), on or before the date the degree was awarded. Computer science degrees that are accredited may be found on the Internet (http://www.abet.org).


Category B

Applicants who have a bachelor's degree in something other than the list above can still qualify to take the exam by demonstrating that they have scientific or technical training that is equivalent to that received at an accredited American college or university for a bachelors degree in one of the fields listed above. If you qualify under Category B, you must furnish both original transcripts as well as copies of the course descriptions. There are four ways to qualify as a Category B applicant

1) 24 Semester hours of physics for physics majors.

2)
32 semester hours in a combination consisting of the following:
8 semester hours of chemistry or 8 semester hours of physics, and
24 semester hours in biology, botany, microbiology, or molecular biology.
The 8 semester hours in chemistry or 8 semester hours of physics must be obtained in two sequential courses, each course including a lab. Only courses for science or engineering majors will be accepted.

3) 30 semester hours of chemistry for chemistry majors.

4) 40 semester hours in a combination consisting of the following: 8 semester hours of chemistry or 8 semester hours of physics, and 32 semester hours of chemistry, physics, biology, botany, microbiology, molecular biology, or engineering. (For Computer Science, see other acceptable course work.) The 8 semester hours of chemistry or 8 semester hours of physics must be obtained in two sequential courses, each course including a lab. Only courses for science or engineering majors will be accepted.

Category C
Practical Engineering or Scientific Experience. An applicant relying on practical engineering or scientific experience or who does not qualify under Category A or B above may establish the required technical training by demonstrating that he or she has taken and passed the Fundamentals of Engineering (FE) test. The FE test is a test of engineering fundamentals. The FE test is developed and administered by a State Board of Engineering Examiners in each State or comparable jurisdiction. Neither the USPTO nor any other U.S. Government agency administers the test. Applicants desiring to take the FE test should direct inquiries to the Secretaries of the appropriate State Boards. Official results of the FE test must be submitted to establish qualification under this category. Applicants attempting to qualify under Category C must submit an official original transcript showing the award of a Bachelors degree.

The individual is responsible for the execution of all aspects of the company’s patent procurement activities. The individual will review invention disclosure submissions, scheduled department review of same to determine filing strategy, communicate company strategy to patent counsel and manage patent counsel performance. The individual will also be responsible for managing all patent prosecution outside of the U.S. by working directly with foreign patent counsel. The individual will also support corporate IP counsel in any IP clearance and enforcement matters.

Major Functions:

Prepare, file, and prosecute U.S. and foreign patent applications
Assist IP Attorneys with handling various in-house patent prosecution matters
Assist IP Attorneys and inventors with capturing, documenting and reviewing novel ideas and inventions
Effectively communicate and interact with inventors
Manage out side patent counsel in US and abroad
Provide support of international filing/prosecution efforts
Active, pull-through collaboration with engineers in patent creation
Routinely works with reviewers of invention disclosures to set priorities for specific disclosures. May suggest priority based on fit with business strategy
Routinely meets with inventors and attorneys during initial patent drafting meetings for at least high priority applications. May suggest approaches to broaden patent coverage
Conducts prior art searches as requested. Can conduct patentability searches and landscape searches independently
Can make detailed suggestions to inventors about areas to strengthen their invention disclosure

Skills & Abilities:

Must have strong communication skills, including mastery of the English language
Ability to contribute as a team member and work independently
Must be organized and resourceful

Education & Experience:
B.S. in Electrical Engineering or equivalent work experience
Patent Agent registered before the USPTO
Applicable knowledge of patent law, including 3+ years with preparing, filing, and/or prosecuting of patent applications
Experience with all common Microsoft Office software

JOB DUTIES:

Hours: 9:30 a.m. – 5:30 p.m.
Provide assistance with intellectual property matters, with particular emphasis in preparing and prosecuting applications and patent portfolio management. Conduct scientific and technical evaluations, due diligence and validity and infringement analyses.

QUALIFICATIONS:
Must be specifically listed on resume in order to be considered for this position.
Bachelor’s Degree of a scientific or engineering discipline involving mechanical engineering.
Entry level or one plus years of patent agent experience required.

ADDITIONAL QUALIFICATIONS:
A PhD or Masters Degree a plus. Ability to identify and analyze issues and problems and to recommend and implement solutions. Strong PC skills, including knowledge of legal research with particular emphasis in patent related materials. Ability to pay close attention to details. Strong interpersonal skills. Reliability, flexibility, and team oriented; professional demeanor required. Clearance of Firm standard background checks required.
